II. Rights of users and persons concerned

With a view to the data processing described in more detail below, users and data subjects have the right to

  •  confirmation of whether data concerning them are processed, information on the data processed, further information on data processing and copies of the data (cf. also Art. 15 GDPR);
  • correction or completion of incorrect or incomplete data (cf. also Art. 16 GDPR);
  • to the immediate erasure of the data concerning them (cf. also Art. 17 GDPR), or, alternatively, if further processing is required pursuant to Art. 17 para. 3 GDPR, to the restriction of processing pursuant to Art. 18 GDPR;
  • on receipt of the data concerning them and provided by them and on transmission of this data to other providers/responsible parties (cf. also Art. 20 GDPR);
  • upon complaint to the supervisory authority if they are of the opinion that the data concerning them are processed by the provider in violation of data protection provisions (cf. also Art. 77 GDPR).
In addition, the provider is obliged to inform all recipients to whom data have been disclosed by the provider about any correction or deletion of data or the restriction of the processing which takes place on the basis of Articles 16, 17, para. 1, 18 GDPR. However, this obligation shall not apply if such notification is impossible or involves a disproportionate effort. Notwithstanding this, the user has a right to information about these recipients.

Users and data subjects also have the right to object to the future processing of data concerning them in accordance with Art. 21 GDPR, provided that the data are processed by the provider in accordance with Art. 6 para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose of storage ceases to apply, the deletion of the data does not conflict with any legal storage obligations and no other information on individual processing procedures is provided below.

Server data

For technical reasons, in particular to ensure a secure and stable Internet presence, data is transmitted to us or to our web space provider via your Internet browser. With these so- called server log files, the type and version of your Internet browser, the operating system, the website from which you switched to our Internet presence (referrer URL), the website(s) of our Internet presence that you visit, the date and time of the respective access as well as the IP address of the Internet connection from which our Internet presence is used are collected.

These data collected in this way will be temporarily stored, but not together with other data of yours.

This data is stored on the legal basis of Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our Internet presence.

The data will be deleted after seven days at the latest, unless further storage is required for evidentiary purposes. Otherwise, all or part of the data will be excluded from deletion until an incident is finally resolved.

Cookies

a) Session-Cookies

We use so-called cookies on our website. Cookies are small text files or other storage technologies that are stored on your end device by the Internet browser you use. These cookies process certain information about you, such as your browser or location data or your IP address, to an individual extent.

This processing makes our website more user- friendly, effective and secure, as the processing enables, for example, the reproduction of our website in different languages or the offer of a shopping basket function.

The legal basis for this processing is Art. 6 Para. 1 lit b.) GDPR, insofar as these cookies process data for contract initiation or contract execution.

If the processing does not serve to initiate or process a contract, our legitimate interest lies in improving the functionality of our Internet presence. The legal basis is then Art. 6 para. 1 lit. f) GDPR.

When you close your Internet browser, these session cookies are deleted.

b) Third-party-Cookies

If necessary, our website may also use cookies from partner companies with whom we cooperate for the purpose of advertising, analysis or the functionalities of our website.

Please refer to the following information for details, in particular for the purposes and the legal basis of the processing of such third-party cookies.

c) Removal possibility

You can prevent or restrict the installation of cookies by setting your Internet browser. You can also delete cookies that have already been saved at any time. However, the steps and measures required depend on the Internet browser you are using. If you have any questions, please use the help function or documentation of your Internet browser or contact its manufacturer or support. With so-called flash cookies, however, processing cannot be prevented via the browser settings. Instead, you need to change the setting of your Flash player. The steps and measures required for this also depend on the flash player you are using. If you have any questions, please also use the help function or documentation of your Flash Player or contact the manufacturer or user support.

Should you prevent or restrict the installation of cookies, however, this may lead to the fact that not all functions of our Internet presence are fully usable.

Contract execution

The data transmitted by you for the use of our range of goods and/or services will be processed by us for the purpose of contract processing and are required in this respect. Conclusion and processing of the contract are not possible without the provision of your data.

The legal basis for processing is Art. 6 para. 1 lit. b) GDPR.

We delete the data with complete contract processing, but must observe the tax and commercial law retention periods.

Within the scope of contract processing, we pass on your data to the transport company entrusted with the delivery of goods or to the financial service provider if the transfer is necessary for the delivery of goods or for payment purposes.

The legal basis for the transfer of the data is then Art. 6 para. 1 lit. b) GDPR.

Customer account / registration function

If you create a customer account with us via our website, we will collect and store the data you entered during registration (e.g. your name, address or e-mail address) exclusively for pre-contractual services, for contract fulfilment or for customer care purposes (e.g. to provide you with an overview of your previous orders with us or to be able to offer you the so-called notepad function). At the same time we will save the IP address and the date of your registration together with the time. A passing on of these data to third parties does not take place naturally.

In the course of the further registration process, your consent to this processing will be obtained and reference will be made to this data protection declaration. The data collected by us will be used exclusively for the provision of the customer account.

If you consent to this processing, Art. 6 para. 1 lit. a) GDPR is the legal basis for the processing.

If the opening of the customer account also serves pre-contractual measures or the fulfilment of the contract, the legal basis for this processing is also Art. 6 para. 1 lit. b) GDPR.

You may revoke your consent to the opening and maintenance of the customer account granted to us at any time with future effect in accordance with Art. 7 para. 3 GDPR. All you have to do is inform us of your revocation.

The data collected in this respect will be deleted as soon as processing is no longer necessary. However, we must observe retention periods under tax and commercial law.

Contact inquiries / contact possibility

If you contact us via contact form or e-mail, the data you provide will be used to process your request. Providing the data is necessary for processing and answering your inquiry - without their provision we cannot answer your inquiry or, if necessary, only to a limited extent.

The legal basis for this processing is Art. 6 para. 1 lit. b) GDPR.

Your data will be deleted if your inquiry has been finally answered and there is no legal obligation to keep your data safe, e.g. in the case of a possible subsequent contract processing.

User contributions, comments and ratings

We offer you the opportunity to publish questions, answers, opinions or evaluations on our website, hereinafter referred to as "articles" only. If you make use of this offer, we will process and publish your contribution, the date and time of submission and the pseudonym you may use.

The legal basis for this is Art. 6 para. 1 lit. a) GDPR. You may revoke your consent at any time with effect for the future pursuant to Art. 7 para. 3 GDPR. All you have to do is inform us of your revocation.

In addition, we also process your IP address and e-mail address. The IP address is processed because we have a legitimate interest in taking or supporting further action if your contribution infringes the rights of third parties and/or is otherwise unlawful.

In this case, the legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in legal defence, if necessary.

Google Analytics

We use Google Analytics on our website. This is a web analysis service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter only called "Google".

Through certification according to the EU-US privacy shield ("EU-US Privacy Shield")

Google guarantees that the EU's data protection regulations will also be observed when processing data in the USA.

The Google Analytics service is used to analyse the usage behaviour of our website. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization and economic operation of our Internet presence.

Usage and user-related information, such as IP address, location, time or frequency of the visit to our website, are transmitted to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymisation function. With this function Google shortens the IP address already within the EU or the EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data can also be used to provide other services related to the use of our Internet presence and the use of the Internet.

Google states that it will not connect your IP address to other data. In addition, Google keeps

https://www.google.com/intl/de/policies/privacy/partners

Further information on data protection law is available to you, e.g. also on the possibilities to prevent the use of data.

In addition, Google offers under

https://tools.google.com/dlpage/gaoptout?hl=de

a so-called deactivation add-on together with further information. This add-on can be installed with the most popular Internet browsers and offers you further control over the data that Google collects when you visit our website. The add-on informs Google Analytics' JavaScript (ga.js) that information about visits to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services. Whether and which other web analysis services are used by us, you will of course also find out in this data protection declaration.

Google reCAPTCHA

In our website we use Google reCAPTCHA to check and avoid interactions on our website by automated access, e.g. by so-called bots. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter only called "Google".

Through certification according to the EU-US privacy shield ("EU-US Privacy Shield")

https://www.privacyshield.gov/participant? id=a2zt000000001L5AAI&status=Active

Google guarantees that the EU's data protection regulations will also be observed when processing data in the USA.

Through this service Google can determine from which website a request is sent and from which IP address you use the so-called reCAPTCHA input box. In addition to your IP address, Google may collect other information necessary to provide and guarantee this service.

The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the security of our Internet presence and in the prevention of unwanted, automated access in the form of spam or similar.

Google offers under

https://policies.google.com/privacy

provides further information on the general handling of your user data.

Olark

We use a live chat tool that allows our website visitors to easily contact our staff. The aim is that the visitors of our website can ask questions without delay and that these can be answered quickly or that the customers receive purchase advice. The data of the customer inquiry and contact data are recorded and stored. Only in this way can we process the desired contact request in a meaningful way. For this we need the customer name as well as the e-mail address. These data will not be passed on to third parties without your express consent.

The data entered in the chat window will only be processed on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this permission at any time by sending us an informal e-mail. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

The provider of the software used is Olark, 205 ½ N Main St. Ann Arbor, MI 48104, USA. Olark participates in the EU-US data protection shield agreement and the "Swiss-US Privacy Shield" agreement and is certified for compliance with them. See the following link: https://www.privacyshield.gov/participant?id=a2zt000000000eaAAA

In addition, Blue Level GmbH has concluded a contract with Olark for order data processing in accordance with the EU standard contract clauses.

YouTube

We use YouTube on our website. This is a video portal of YouTube LLC, 901 Cherry Ave, 94066 San Bruno, CA, USA, hereinafter referred to as "YouTube".

YouTube is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google".

Through certification according to the EU-US privacy shield ("EU-US Privacy Shield")

Google and its subsidiary YouTube guarantee that the data protection regulations of the EU will also be observed when processing data in the USA.

We use YouTube in conjunction with the "Advanced Privacy Mode" feature to show you videos. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our Internet presence. According to YouTube, the "Extended data protection mode" function means that the data specified below will only be transmitted to the YouTube server if you actually start a video.

Without this "Extended Privacy Policy", a connection to the YouTube server in the USA will be established as soon as you access one of our Internet pages on which a YouTube video is embedded.

This connection is required in order to be able to display the respective video on our website via your Internet browser. In the course of this, YouTube will at least record and process your IP address, the date and time as well as the website you visited. In addition, a connection to the Google advertising network "DoubleClick" is established.

If you are logged in to YouTube at the same time, YouTube will assign the connection information to your YouTube account. If you wish to prevent this, you must either log out of YouTube before visiting our website or make the appropriate settings in your YouTube user account.

For the purpose of functionality and analysis of usage behavior, YouTube permanently stores cookies via your Internet browser on your terminal. If you do not agree to this processing, you have the option of preventing the storage of cookies by setting it in your Internet browser. You will find more detailed information on this under "Cookies" above.

Further information about the collection and use of data as well as your rights and protection options in this regard is held by Google in the databases listed under

retrievable data protection information.

Google AdWords mit Conversion-Tracking

In our website we use the advertising component Google AdWords and the so-called conversion tracking. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter only called "Google".

Through certification according to the EU-US privacy shield ("EU-US Privacy Shield")

Google guarantees that the EU's data protection regulations will also be observed when processing data in the USA.

We use the conversion tracking for the targeted advertising of our offer. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization and economic operation of our Internet presence.

If you click on an ad placed by Google, the conversion tracking we use stores a cookie on your device. These so-called conversion cookies expire after 30 days and do not serve your personal identification.

If the cookie is still valid and you visit a specific page of our website, both we and Google can evaluate that you clicked on one of our ads placed on Google and that you were then forwarded to our website.

Google uses the information collected in this way to compile statistics for us about visits to our website. In addition, we receive information about the number of users who clicked on our advertisement(s) as well as about the pages of our Internet presence that are subsequently called up. Neither we nor third parties who also use Google AdWords will be able to identify you in this way.

You can also prevent or restrict the installation of cookies by making the appropriate settings in your Internet browser. At the same time, you can delete cookies that have already been saved at any time. However, the steps and measures required depend on the Internet browser you are using. If you have any questions, please use the help function or documentation of your Internet browser or contact its manufacturer or support.
